Loan sharks in Hazyview contravene credit act

Nozipho Yolanda Precious Mabuza (34), Baby Miko (42) and Sibusiso Nyundu (35) were found guilty and sentenced for contravening Section 133 of the National Credit Act, Act 34 of 2005.

Nozipho Yolanda Precious Mabuza was sentenced by the Hazyview Magistrate’s Court on Thursday April 28, to a R5 000 fine or 12 months’ imprisonment, or wholly suspended for five years on condition she is not found guilty on similar charges in the future.

She was arrested by the Hawks Serious Commercial Crime Investigation team based in Mbombela and National Credit Regulators during a search and seizure operation at Hazyview Humelela Cash Loans in November. Over 500 bank cards, R36 730 cash, Sassa cards and ID documents were found and seized from her premises.

Baby Miko and Sibusiso Nyundu were found guilty and sentenced by the Masoyi Magistrate’s Court on Wednesday May 4.

The accused men were found in possession of bank cards and Sassa cards reportedly taken from the clients when they received cash loans from these loan sharks, while they were not registered with the National Credit Regulator. They kept the clients’ cards to secure monthly back payments. The court sentenced Nyundu to R10 000 or 12 months’ direct imprisonment, while Miko was sentenced to a R8 000 fine or 10 months’ direct imprisonment.
