1. The purchaser shall pay auctioneer`s commission subject to a maximum of
R40 000.00 plus vat and a minimum of R3000.00 plus vat.
2. The purchaser shall pay to the sheriff a deposit of 10% of purchase price immediately on demand by the Sheriff, in cash or by bank guaranteed cheque on the day of the sale.
3. The balance of the purchase price and any such interest payable shall be paid to the Sheriff against transfer and shall be secured by a bank guarantee issued by a financial institution, to be approved by the plaintiff`s attorney, which shall be furnished to the Sheriff within 21 days after the date of sale.
4. The property may be taken possession after signature of the conditions of sale, payment of the deposit and upon the balance of the purchase price being secured.
5. Should the purchaser receive possession of the property, the purchaser shall be liable for occupational rent at an amount to be determined by the owner, per month, from date of occupation to date of transfer.
6. The rules of auction are available 24 hours prior to the auction at the offices of the OFFICE OF THE SHERIFF MBOMBELA situated at 99 JACARANDA STREET, WEST ACRES, MBOMBELA.
7. The auction will be conducted in accordance with the Consumer Protection Act 2008, as amended.
8. Registration as buyer is a pre-requisite subject to conditions, inter alia:
a) Directive of the Consumer Protection Act 68 of 2008 & Rule 46 of the Uniform Court Rules

b) FICA-legislation – all bidders are to provide proof of identity and residential address particulars.
c) Payment of a registration fee – R10 000.00 CASH – refundable after sale, if not buying.

9. The aforesaid sale shall be subject to the conditions of sale which may be inspected at the office of the Sheriff, during office hours at the OFFICE OF THE SHERIFF MBOMBELA situated at 99 JACARANDA STREET, WEST ACRES, MBOMBELA.
