INFORM: KHUMALO NATHANIEL, IDENTITY NUMBER: 830813 5625 084, an adult male person, last known to be working at NHLS (National Health Laboratory Service) as a Clerk Receiver at Corner Madiba Drive and Piet Retief Street, Rob Ferreira, Nelspruit, residing at stand no 3227, Extension 10, Barberton. (Hereinafter referred to as the Defendant).
THAT: BUSISIWE LINDOKUHLE NGOMANE, IDENTITY NUMBER:
900311 0391 088, an adult female person, employed as an interm at Mbokodo Publishers residing at Stand no 1216 Gbhoboza (Dantjie Trust) a, Mbombela (hereinafter referred to as the Plaintiff); hereby institutes action against Defendant in which the Plaintiff claims the relief on the grounds set out in Particulars of claim annexed hereto.
INFORM, the Defendant further that if she disputes the claim and wishes to defend the action she must:
(1.) Within TEN (10) days of service upon her, this summons, file with the Registrar of this court at MBOMBELA a notice of intention to defend and serve a copy thereof to the Plaintiff`s attorneys, which notice shall give an address (not being a post office box or poste restante) referred to in rule 19(3) for the service upon the Defendant of all notices, and documents in the action, such that an address is within FIFTEEN (15) kilometers from the office of the registrar.
(2.) Thereafter, and within TWENTY (20) court days after filling and service of notice of intention to defend as aforesaid, file with the registrar, and serve upon the Plaintiff a plea of execption, notice to strike out with a counterclaim.
INFORM, the Defendant further that if she fails to file, and serve notice as aforesaid, judgment as claimed may be given against her without any further serve upon the Plaintiff a plea of exception, notice to strike out with a counterclaim. INFORM, the Defendant further that if she fails to file, and serve notice as aforesaid, judgment as claimed may be given against her without furher notice to her, or if having filed, and served such notice, fails to pleas except, make application to strike out or counterclaim judgment may be given against her.
AND IMMEDIATELY thereafter serve on the Defendant a copy of this summons and return the same to the Registrar with whatsoever you have done thereupon.
