The Wilsons were both killed in a fatal collision at the crossing of Dr Mandela Drive and Samora Machel Street on March 31, 2019.

An eyewitness told investigators that Singwayo struck Mr Wilson’s vehicle at the crossing after allegedly skipping a red traffic light.

After years of inaction by both the police and the National Prosecuting Authority (NPA), Mr Wilson’s daughter, Cindy Potgieter, approached AfriForum’s Private Prosecuting Unit, who immediately took the case under review pro bono.

After months of back-and-forth between the unit’s advocate, Phyllis Vorster, and local control prosecutors, the case finally made it to Magistrate Deon Minnie’s district court, where Singwayo indicated he wanted to defend himself against the charges.

Singwayo, however, changed his mind and agreed to legal aid after Minnie warned him of the seriousness of the indictments.

During a previous interview with the Middelburg Observer, Ms Potgieter said she was “angry, bitter and broken”, after not only losing her father and brother but her mom, Sonja Wilson, too.

Mrs Wilson, who contracted Covid-19 two years after the fatal accident in 2021, “gave up the will to fight”.
“Before her passing my mom said, ‘I’m tired, I can’t go on without my child’.”

Ms Potgieter says she believes her mother would have survived with the support of her father and brother.

“We sent several update requests to the office of a senior state prosecutor in Middelburg, only to be told the docket was incomplete, stalling prosecution, despite the eyewitness account,” Advocate Vorster says.

“This was never communicated to the family of the Wilsons,” she adds.

Ms Vorster says her unit, under the stewardship of Advocate Gerrie “Bulldog” Nel, is inundated daily by victims of crime for intervention over the state’s bungling of investigations and prosecutions.

Singwayo will appear in court again on November 24.
