Double murder case postponed

Man accused of murdering both his girlfriend and her lover will face the court again on March 25 2015.

MBOMBELA – Illness motivated the postponement of proceedings in the Mbombela Circuit of the Gauteng High Court’s Eastern Division today.

The past week saw numerous testimonies being presented against Mr Boy Edwell Makhubela (37), who stands accused of killing Lindeni Sengwayo and Alphios Mike Magagula on December 29, 2012.

Mr. Foster Patrick Sambo, brother of Sengwayo, testified that he saw the shooting take place.  He said that the accused cocked a gun and asked both deceased whether they want to live or die. They did not answer him.

The accused pointed the gun into the ground and repeated this question, firing the gun into the ground before repeating the question again. Sambo testified that the accused pointed the gun at Magagula and shot him. Sambo’s testimony in the Mbombela Circuit of the High Court’s Eastern Division had members of the gallery in tears and he could continue after a court official assisting in calming those in attendance. He testified that the accused fired a second and third shot at Magagula before he fell to the ground and died. The accused then shot at Sengwayo.

Medical reports indicate that Sengwayo died as a result of a gunshot to the heart that caused haemorrhagic shock. Magagula’s cause of death was indicated to be multiple gunshot wounds resulting in loss of blood.

The case was postponed on request of the accused today as he has fallen ill.
