Unfair decision alleged by accussed

A large contingent of community members gathered to hear and support a self-proclaimed "reformed" gangster in his bail application last Tuesday.

Gift “Scapbro” Mnisi (25) was granted R10 000 bail in a packed Barberton Magistrate’s Court.

He is now waiting for a date for the appeal to be heard.

After the granting of bail Mnisi received a hero’s welcome from his supporters.

He has appealed the five-year prison sentence imposed on him on January 23.

According to Mnisi, the grounds for his appeal are that the sentence was too harsh and that the magistrate, Sheila

Msibi, was unfair in her decision as there was no proof of the allegations levelled against him.

“The judge was unfair when she took the decision, as she did not consider the fact that there was no evidence that we intimidated the investigation officer, Whisky Shabangu. Another fact is I was not on good terms with the said investigating officer, as he is the one who objected to our initial bail application without good reason,” said Mnisi.

In addition, he complained that his co-accused Themba Mwali was acquitted on the same charge of intimidation.

Mnisi said he wants justice to be done, as he also committed himself on January 20 to whatever might happen in his life, including going to jail.

He said he has vowed to work hand in hand with the police to fight crime in the area.
