The urgent High Court application for the release of funds from the estate of the late former deputy president David Mabuza has been postponed.

Mpumalanga Division of the High Court Deputy Judge President Takalani Ratshibvumo presided over the matter today, Tuesday, September 29.

Ratshibvumo postponed the matter to Friday, October 2, after the court heard that a minor child who is also cited as a beneficiary of Mabuza’s estate was not represented in court.

Mabuza, former deputy president of South Africa, died on July 3, 2025, after falling ill.

Among the legal representatives participating in the proceedings were Advocate DJ Sibuyi of Mthunzi Law Chambers, assisted by Advocate Buyile Mdluli and Attorney Tatenda Magocha.

Other legal representatives included Advocate Aubrey Milazi and Advocate Sieberhagen representing the two applicants and 13 respondents.

The court heard that Bazooka Attorneys, who were supposed to be present on behalf of a minor child cited as one of the respondents, were not in attendance.

Ratshibvumo interrogated the parties on whether Bazooka Attorneys had been properly served with the court papers.

It was established that there was no proof beyond reasonable doubt that they had been served.

One of Mabuza’s daughters, Tamara Silinda, and her mother Emunah Silinda (previously known as Funi Silinda) are the applicants in the matter.

Tamara has applied for the court to compel the estate curators to release maintenance and tuition funds.

The court papers cite 13 respondents, including the Master of the High Court, Standard Bank, and court-appointed estate curators Jennifer Faber and Paul Roos, alongside co-respondent Marthinus Jacobus Dewald Breytenbach. Both Faber and Roos were appointed as curators under letters of curatorship issued on February 3.

Eight family members and beneficiaries are also named as respondents, including Nonhlanhla Patience Mnisi, Mxolisi David Junior Mabuza, Lindeni Innocentia Mabuza, Mandisa Vanessa Mabuza, Nkosinathi Mabuza, Angela Mabuza, Fezile Mabuza and the minor child.

According to court filings submitted by Mphekgwane Attorneys, Tamara is asking the court to order the curators to process and pay her tertiary education expenses directly to her educational institution within five days of a court order being granted.

In addition, the applicants are seeking an order directing the curators to release funds for immediate and necessary personal living expenses set out in a schedule marked as Annexure R.

The application also demands full enforcement of a prior High Court directive handed down on February 3, which defined the administrative duties of the curators.
