Ntsiki Mazwai’s court loss cost her R200k, rape-accused DJ Fresh tells MacG

Mazwai was among the many people who republished the rape allegations, however, she is one of the few people the DJ took legal action against. 


DJ Fresh recently revealed that sharing what he calls “unsubstantiated” claims against him cost Ntsiki Mazwai hundreds of thousands of rands.

About R200,000 by his estimation. 

The DJ, whose real name is Thato Sikwane, made this and other revelations during a recent chat with Podcast and Chill’s Macgyver “MacG” Mukwevho and Sol Phenduka. 

The conversation spanned over two episodes of the podcast of over one hour each, and touched on everything from his upbringing to his career and the rape allegations levelled against him.

He began by recalling the first time his name was mentioned on what Twitter users now call “the list”.

The list refers to names of South African people who were named at the height of a “Me Too” moment on the microblogging platform and DJ Fresh’s name was mentioned numerous times. 

Mazwai was among the many people who republished the allegations, however, she is one of the few people the DJ took legal action against. 

Referring to her as “some poet girl”, Fresh shared details about what transpired when he sued her. 

“After that list happened, I did my statement to say that ‘that’s bullshit, that never happened’ and life carried on,” said the DJ. 

He added that he had thought the issue had “gone away” but Mazwai republished the allegations levelled against him, prompting him to call his lawyers to intervene. Penny Lebyane also ended up included in the case in a bizarre turn of events.

He labelled her choice to stand her ground “arrogant” and spoke about the way in which she chose to enact her activism.

“The arrogance carried on, so it went to court and then she lost… with costs. And I think the costs were almost two hundred grand. And it didn’t have to go there, this thing could have ended immediately.”

He went on to recall what the judge said when handing down judgment in the case and commented about how activism comes with responsibility and consequences.

DJ Fresh added that he was a fan of Mazwai’s but complained further about her “boldness”.

“The weirdest thing is I’m actually one of her biggest fans. I love the fact that she is bold like that. But don’t be bold for the sake of it when you can either check if something happened or not. If you don’t have the facts then leave it alone.”

DJ Fresh also revealed that after he had won his case, Mazwai had sent one of his followers a direct message, reprimanding this follower for celebrating Fresh while his victim continued to suffer. 

It is for this reason that Fresh says he believes the allegations levelled against him were “orchestrated”.

He concluded by stating that he “can’t say too much” as the matter is “still going to court”.
