Mpofu’s free legal advice to Sihle Zikalala
ANC 'rebel branches' in KZN came out victorious as the high court ruled that 2015's provincial elective conference was unlawful and invalid.

EFF national chairperson Dali Mpofu has taken to social media to give ANC KZN chairperson Sihle Zikalala free advice following the court ruling.
ANC councillor Lawrence Dube and four others took the provincial party leadership to court in May last year to declare the legitimacy of KwaZulu-Natal’s 8th provincial elective conference, held in November 2015 in Pietermaritzburg, null and void.
The case, which dealt with alleged irregularities in the arrangement, hosting and auditing of the 2015 conference, was brought before the court against the ANC’s sitting provincial executive committee (PEC) by members from 43 so-called rebel branches that want the conference declared illegal and a rerun to be held.
The “rebel branches” came out victorious on Tuesday as the Pietermaritzburg High Court ruled that the ANC’s KwaZulu-Natal 2015 elective conference was unlawful and invalid.
The ANC KZN released a statement following the ruling, saying it would study the judgment and “interact with our structures on the political ramifications of the decision prior to placing the matter before the appropriate political platform for a decision on the way forward”.
Speculation is that they will appeal the judgment.
Meanwhile, Mpofu has given Zikalala free legal advice on how to conduct himself now that he’s no longer the chairperson.
“Free legal advice to Sihle Zikalala: As we speak now there’s no Provincial Executive Committee in KZN. Please don’t call yourself chairperson,” he told Zikalala, though some of the advocate’s followers disagreed with him.
They said Zikalala had every right to call himself chairperson, as he “is a person, that sits on a chair, so Chairperson”.
The court judgment has also been celebrated by EFF deputy chairperson Floyd Shivambu, who lauded Advocate Tembeka Ngcukaitobi for the victory.
