Court grants bail to Burgersfort attorney charged with fraud

"However, the court granted him bail with conditions that Mola was to hand over his passport to the investigation officer. He cannot travel outside the country and should not have any direct or indirect contact with complainants and witnesses relating to this matter."

BURGERSFORT – A local attorney, Nkoemakae Mola (42) of Mola Attorneys, was granted R10 000 bail by the Pretoria North Magistrate’s Court last week. He was charged with 15 counts of fraud and 15 counts of theft. Mola is a member of the Pan Africanist Congress of Azania in Sekhukhune.

Since 2019, Mola allegedly defrauded potential house buyers of an amount of over R2 million by pretending to be the lawyer handling the sale of a property.

“It is alleged that he would ask any potential buyer to deposit a certain amount into Mola Attorneys’s bank account for the property. When the money reflected in the account, he would allegedly then transfer the money to his private account,” said Lumka Mahanjana, the spokesperson for the National Prosecuting Authority in Gauteng. She said after several cases were opened, Mola was arrested in his house in Burgersfort (Alverton) on July 6.

“The prosecutor opposed his bail, stating that Mola was a flight risk and that the complainants are known to him, which might lead to intimidation. He further stated that Mola is likely to commit similar offences while out on bail,” said Mahanjana.

“However, the court granted him bail with conditions that Mola was to hand over his passport to the investigation officer. He cannot travel outside the country and should not have any direct or indirect contact with complainants and witnesses relating to this matter.”

The matter was postponed to October 27 for further investigations.
